SAN DIEGO, - March 29, 1995 - Attached is a letter from Vincent Moeyersoms, president and chief operating officer of the America3 Foundation, to the America's Cup International Jury clafifying the position of America3 regarding our protest to recent action by Team Dennis Conner to a keel change during a "no-change" period. While Moeyersom's letter is self-explanatory, in brief, the attached documents support America3's position and raise the following questions:
1. Was the damage caused to Stars & Stripes the result of a technical design problem? (Technology is as much a part of the America's Cup as the sailing itself.)
2. Was the keel of Stars & Stripes replaced with a "similar" keel, as the rules stipulate?
3. Was the keel moved from its original position?
4. Does the Defense Committee have authority over the IACC Technical Director and Chairman of the Measurement Committee, Ken McAlpine?
(Note: McAlpine's memo of March 28 to Wytie Cable in which McAlpine states in paragraph three that he does not concur with Cable's assumption that the replacement appendage is "similar to the appendage being replaced" - (See item #4 in Wytie Cable's letter of March 27 to Ken McAlpine.)
These are the issues for which we are asking consideration from the International Jury. By denying America3 access to the International Jury, which is our due process, the Defense Committee is thereby denying America3 any recourse or access to the appellate process.
